PURPOSE AND SCOPE

These Website Terms & Conditions apply to the use of Deaf Victoria’s website at https://deafvictoria.org.au/ and to online membership applications, membership renewals, donations, event or program registrations and other website functions where applicable.

By using the website, you agree to these Terms. Additional terms may apply to a particular membership category, event, program, campaign or service and will be identified at the relevant point of registration.

ABOUT DEAF VICTORIA

Deaf Victoria is a Victorian organisation representing and supporting Deaf and hard of hearing Victorians. The website provides information about Deaf Victoria, its advocacy, programs, services, events, membership, resources, campaigns, fundraising and community activities.

USE OF THE WEBSITE

You may use the website for lawful purposes. You must not:

  • Use the website in a way that breaches applicable law or infringes the rights of another person.
  • Attempt to gain unauthorised access to the website, systems, accounts or data.
  • Introduce malicious code, interfere with website security or disrupt the operation of the website.
  • Use website content in a misleading, defamatory or unlawful way.
  • Provide information that you know is false, misleading or unauthorised when completing a form, application, registration or payment.

Deaf Victoria may restrict or suspend access where reasonably necessary to protect the website, its users, Deaf Victoria or third parties.

ACCESSIBILITY

Deaf Victoria aims to make its website and digital information accessible to Deaf and hard of hearing people. Content may be provided in written English, Auslan, captioned video or other accessible formats. If you experience an accessibility barrier or require information in another accessible format, please contact Deaf Victoria.

MEMBERSHIP

Membership applications and renewals made through the website are subject to Deaf Victoria’s Constitution, membership categories, eligibility requirements and any membership rules or fees in force at the time.

Payment of a membership fee does not by itself create or guarantee membership where an application must first satisfy Deaf Victoria’s membership requirements or be approved in accordance with the Constitution.

Members are responsible for providing accurate and current contact information and for notifying Deaf Victoria of relevant changes.

MEMBERSHIP FEES AND PAYMENTS

Where membership fees or other permitted payments are made through the website:

  • Fees are stated in Australian dollars (AUD) and include GST where applicable.
  • You must provide accurate information and use a payment method you are authorised to use.
  • Payments may be processed by PayPal or another payment provider identified at the time of payment.
  • Deaf Victoria does not store complete payment card details.
  • The payment transaction may also be subject to the terms and privacy practices of the relevant payment provider.

If a payment is duplicated, made in error or appears unauthorised, please contact Deaf Victoria promptly so it can be investigated.

MEMBERSHIP CANCELLATIONS AND REFUNDS

Membership fees are generally non-refundable once membership has commenced, except where required by law or where Deaf Victoria determines that a refund is appropriate in the circumstances.

A request to cancel membership or seek a refund should be made to info@deafvictoria.org.au. Cancellation of membership is also subject to Deaf Victoria’s Constitution and any applicable membership rules.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under applicable Australian law.

DONATIONS

Where the website accepts donations, donations are voluntary. Unless required by law or an error has occurred, donations are generally not refundable. If you believe a donation was made in error or without authority, contact Deaf Victoria as soon as possible.

Any statement about tax deductibility applies only where expressly stated and legally available. Donor information is handled in accordance with Deaf Victoria’s Privacy Policy.

EVENT AND PROGRAM REGISTRATIONS

The website may allow registration for Deaf Victoria events, workshops, consultations, programs or other activities. Additional terms, eligibility requirements, fees, cancellation arrangements or consent requirements may apply and will be communicated at registration where relevant.

Deaf Victoria may change, postpone or cancel an event or activity where reasonably necessary. Where a paid registration is affected, Deaf Victoria will advise participants of the available options.

INTELLECTUAL PROPERTY

Unless otherwise stated, website content including text, Auslan videos, images, graphics, logos, publications, resources and designs is owned by or licensed to Deaf Victoria and is protected by applicable intellectual property laws.

You may view, download or print website material for personal, non-commercial use. You must not reproduce, adapt, publish, distribute, commercially exploit or represent Deaf Victoria content as your own without permission, except where permitted by law or expressly stated on the website.

PRIVACY

Deaf Victoria handles personal information in accordance with its Privacy Policy and applicable privacy law. The Privacy Policy explains the kinds of information Deaf Victoria collects and holds, how it is used and disclosed, how it is protected, and how a person may seek access or correction or make a privacy complaint.

THIRD-PARTY SERVICES AND LINKS

The website may contain links to third-party websites or use third-party services such as payment, registration, video, mapping, analytics or social media platforms. Deaf Victoria does not control third-party websites and is not responsible for their content, availability or privacy practices.

A link does not necessarily indicate endorsement unless Deaf Victoria expressly states otherwise.

WEBSITE INFORMATION AND AVAILABILITY

Deaf Victoria takes reasonable care to keep website information accurate and current. Information on the website is general information and may change over time. It is not legal, medical, financial or other professional advice unless expressly stated.

Deaf Victoria does not guarantee that the website will always be available, uninterrupted or free from errors, viruses or other harmful components. Website access may be suspended for maintenance, security or other operational reasons.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Deaf Victoria is not responsible for loss arising solely from reliance on general website information, temporary website unavailability, or third-party websites or services outside Deaf Victoria’s reasonable control.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

CHANGES TO THESE TERMS

Deaf Victoria may update these Terms when its website, membership processes, services, technology or legal requirements change. The current version will be published on the website with its effective or review date.

Material changes affecting membership arrangements will be communicated where appropriate.

GOVERNING LAW
